Family Medical Leave (FML) Packet Request

Description of service:

Family Medical Leave guarantees an employee the right to take leave, the right to the continuation of health benefits, and reinstatement to an equivalent or the same position. The FML packet provides the Borough with the necessary information to determine eligibility.

How we process this request:

Hours of work during the last 6 to 12 months are calculated to determine eligibility under the Federal Family Medical Leave Act (FMLA) and/or the Alaska Family Leave Act (AFLA). If the employee meets the hours requirements, an initiation letter and Certificate of Health are sent to the employee to be filled out by a medical provider. Approval is determined after review of the Certificate of Health completed by the medical provider.

Additional Information:

Eligible employees are entitled to family and medical leave for the reasons set out in state or federal law, which include:

  1. The birth of a child of the employee, or the placement of a child with the employee for adoption (or, under federal law, for foster care), provided the leave is taken within one (1) year of the birth or placement.
  2. The need to care for the employee's family member who has a serious health condition.
  3. The employee's own serious health condition which makes the employee unable to perform their job functions.
  4. For qualifying exigencies arising out of the fact that the employee's spouse, son, daughter, or parent is on active duty (or have been notified of an impending call to active duty status) in the Armed Forces in a foreign country.
  5. To care for a FMLA covered service member with a serious injury or illness.
